EXEMPTION FROM SUBPARAGRAPH 421.88(3)(d) OF STANDARD 421 FLIGHT CREW PERMITS, LICENCES AND RATINGS MADE PURSUANT TO SECTION 401.06 OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after having taken into account that the exemption is both in the public interest and is not likely to affect aviation safety, I hereby exempt persons applying for a Flight Instructor Rating – Ultra-light Aeroplane from the requirement set out in subparagraph 421.88(3)(d) of Standard 421 Flight Crew Permits, Licences and Ratings, subject to the following conditions.

Subparagraph 421.88(3)(d) requires a Flight Instructor Rating – Ultra-light Aeroplane applicant to obtain a minimum of ninety percent (90%) in the written examination ULTRA.  

Purpose

The purpose of this exemption is to permit Flight Instructor Rating – Ultra-light Aeroplane applicants to obtain a minimum of sixty percent (60%) in the written examination ULTRA. 

Application

This exemption applies to persons applying for a Flight Instructor Rating – Ultra-light Aeroplane

Conditions

This exemption is subject to the following conditions:

  1. The applicant for a Flight Instructor Rating – Ultra-light Aeroplane shall obtain a minimum of 60% on the written examination Pilot Permit - Ultra-light Aeroplane (ULTRA);
  2. The applicant for a Flight Instructor Rating – Ultra-light Aeroplane shall comply with all other requirements set out in section 421.88 of Standard 421 Flight Crew Permits, Licences and Ratings.

Validity

This exemption is in effect until the earliest of the following:

  1. October 11, 2007 at 23:59 EST;
  2. the date on which any of the conditions of this exemption are breached;
  3. the date on which an amendment modifying subparagraph 421.88(3)(d) of Standard 421 Flight Crew Permits, Licences and Ratings comes into effect; or
  4. the date on which this exemption is cancelled, in writing, by the Minister where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
